Neth hearing slated

Allegations of securities fraud will be presented during a preliminary hearing against former Nye County Commissioner Henry Neth Sept. 30 in Clark County Justice Court.

His attorney, Gus Flangas, said that date could be continued if prosecutors don't soon provide documents requested by his office.

Neth was arrested at his Pahrump home May 14 by investigators for the Nevada Secretary of State's office. He is charged with five counts of securities fraud and one count of embezzlement in connection with a 252-acre Kingman land development.

Neth and his partner Eric Frye are accused of purchasing land in their own name for the development instead of the Stockton Jane Limited Liability Corporation, and diverting funds to another project.

If the judge determines there's enough evidence to bind Neth over to district court for trial at his preliminary hearing, he will then be asked to enter a plea of guilty or not guilty during his arraignment.

Flangas didn't want to comment on particulars of the case, nor did Neth himself.

"This is a pending criminal case, and it's not really appropriate," Flangas said.

Regarding a separate civil matter, Neth wasn't served with the notice of execution sale until Friday afternoon whereby the sheriff's department announced it would auction off parcels Sept. 15 to satisfy an $849,622 judgment won against Neth, Frye, High Valley Estates Inc., Eagle View Group Inc. and Stockton Jane by a group of investors. The sale was announced in a legal notice published in Friday's Pahrump Valley Times.

According to the Nye County Assessor's Office records, the parcels to be auctioned off include property owned solely by Henry and Elizabeth Neth at 4060 S. Frontage Road and at 1100 E. Monoplane Place and a parcel at 6391 N. Alpaca Ave., which is half owned by Fay Provenza.

It also includes a parcel owned by Best Results Investments LLC at 1080 S. Ogden Ave., with a mailing address in care of Scott Smith at 401 S. Frontage Road, the same address as Provenza Neth Properties. Another parcel at 480 W. Northland St., is is owned by Henry and Elizabeth Neth, Donna Lamm and G and C Doehrmann. Still another parcel on the auction block, 3481 S. Rainbow Ave., which includes a home, is owned by Morgan Meyer, according to assessor's office records.

Dr. Jonathan Baktari, one of the parties in the civil lawsuit, said they have, so far, only recovered $10,000 of their judgment against Neth and Frye.
